This page is used to inform website visitors and users regarding Tappy’s policies with the collection, use, and disclosure of Personal Information if anyone decided to use Tappy’s Service.
If you choose to use Tappy’s service, then you agree to the collection and use of information in relation to this policy. The personal information that we collect is used for providing and improving the Service. Tappy will not use or share your information with anyone except as described in this Privacy Policy and Terms of Service.
This Policy applies to the products and services of Tappy, and prior to using the products and services of Tappy, you must read this policy carefully and thoroughly understand this Policy, and use the relevant products or services upon confirming that you fully understand and agree to this policy. By starting to use the various products or services of Tappy, you have fully understood and agreed to this policy.
1. How We Collect and Use Your Personal Information
Personal information means various types of information recorded by electronic or other means that can, independently or in combination with other information, identify a specific natural person or reflect the activities of a specific natural person. We will collect and use your personal information for the following purposes set forth in this Policy:
1.1 To Help You Become Our User
To complete the creation of your account so that we can provide you with services, you are required to provide the following information: your mobile phone number, email address, profile photo, nickname and gender, and create a username and password. For the purpose of service and notice, we may send mails and messages to you through the information aforesaid.
1.2 Information Provided by You to Us
Relevant personal information that you provide to us when registering for an account or using our services, such as your mobile phone number, email address, Facebook Account, bank card number or other payment details; shared information that you provide to another party by using our services, and the information stored when you use our services. You shall ensure that you have obtained the authorization and consent of such party before you provide Tappy with the aforementioned personal information of the party.
When you use our face recognition service, you specifically agree to the collection of your facial recognition information by us or another party.
1.3 Information We Collect During Your Use of the Services
To provide you with results that better meet your requirements and identify abnormal account activity, we will collect information about your use of services and how you use the services, and associate the information that shall include the following.
Device information: we will receive and record information about the device you use, such as the device model, operating system version, device settings, unique device identifier and other information on software and hardware features, and information about the location of the device, such as the IP address, GPS location and Wi-Fi access point, Bluetooth, base station and other sensor information that can provide relevant information, based on the specific permissions that you grant when installing and using the software.
Photo Verification data: If you choose to participate in our Photo Verification feature, we collect your face data, which includes a photo taken from your selfie video, to verify that you’re the real you. The face data will be immediately deleted after the result is returned, which in most cases takes between 5 to 10 seconds (in very rare special cases, it may take up to 24 hours). Once the authentication result is returned, all of your face data will be immediately deleted. Your face data is only used for Photo Verification. Your video selfie itself is not stored and is deleted immediately after you complete Photo Verification. The two screenshots we take from your video selfie are used only for the purposes of auditing and managing this feature. We don't share your face data to any other third party. Before the result is returned, you can request deletion of the face data by writing to our Community team. You can also delete all the information by deleting your Tappy account. In any event, this information is deleted upon account closure, in accordance with our Privacy Policy.
Please note that device information, log information, etc., cannot be independently used to identify information on a specific natural person. If we combine such non-personal information with other information to identify a specific natural person, or use the same in combination with personal information, such non-personal information shall be deemed to be personal information during the period in which the information is used in combination with personal information, and unless authorized by you or otherwise provided for by laws and legislations, we will anonymize or de-identify such personal information.
When you contact us, we may store your correspondence / call records and content or contact details or other information left by you for the purpose of contacting you or helping you resolve issues, or recording the handling plan and outcomes of relevant issues.
1.4 To Provide You with Security Safeguards
To improve the security of your use of the services provided by us and our affiliates and partners, protect the personal safety of and prevent infringement of the property of yourself, other users, or the public, take better measures against phishing websites, fraud, network vulnerabilities, computer viruses, cyberattacks, network intrusions and other security risks, and more accurately recognize violations of laws and legislations or the provisions of relevant agreements and regulations of Tappy, we may use or combine your user information, transaction information, device information, related network logs and information shared by our affiliates and partners with your authorization or in accordance with the law to comprehensively determine your account and transaction risks, conduct identity verification, detect and prevent security incidents, and conduct the necessary recording, audit, analysis and disposal measures in accordance with the law.
1.5 Other Purposes
We will obtain your prior consent when using the information for any other purpose not covered by this Policy, or using the information collected for a particular purpose for any other purpose.
1.6 Exceptions to Obtaining Authorization and Consent
According to the provisions of relevant laws and legislations, we are not required to obtain your authorization and consent when collecting your personal information in the following circumstances:
(I) the personal information is related to national security and the security of national defense;
(II) the personal information is related to public security, public health and significant public interests;
(III) the personal information is related to the investigation of a crime, prosecutions, trials, judgment executions, etc.;
(IV) the personal information is collected for the protection of the life, property and other significant legitimate rights and interests of the subject of the personal information or another person, and it is difficult to obtain your consent;
(V) the personal information that is collected has been publicly disclosed to the general public at your own discretion;
(VI) the personal information is information that has been lawfully and publicly disclosed, such as lawful news reports, government information disclosures and other channels;
(VII) the personal information is necessary for signing and entering into this contract as required by you;
(VIII) the personal information is necessary for maintaining the secure and stable operations of the products or services provided, such as detecting and attending to malfunctions in the products or services;
(IX) the personal information is necessary for lawful news reporting;
(X) the personal information is necessary for academic research institutions to carry out statistical or academic research on the basis of public interests, and when the results of academic research or descriptions are externally provided, the personal information contained in such results shall be de-identified;
(XI) other circumstances provided for by laws and legislations.
If we cease operations of the products or services of Tappy, we will cease further collection of your personal information in a timely manner, notify you of the cease in the operations by sending a notice to every user or through an announcement, and delete or anonymize the personal information held by us.
2. How We Use Cookies and Similar Technologies
2.1 Cookies
To ensure the normal operations of the website, secure easier access for you and recommend content that may be of interest to you, we will store small data files called cookies on your computer or mobile device. Cookies often contain identifiers, site names and some numbers and characters. Cookies allow the website to store your preferences and other data.
2.2 Web Beacons and Pixel Tags
Aside from cookies, we may also use web beacons, pixel tags and other similar technologies on the website. For example, an email that we send you may contain a link to content on our website, and if you click this link, we will track this click to help us understand your preferences for products or services so that we can proactively improve the customer service experience. A web beacon is usually a transparent image embedded in a website or in an email. A pixel tag in an email allows us to know whether the email has been opened. 3. How We Share, Transfer, and Publicly Disclose Your Personal Information
3.1 Sharing
We will not share your personal information with any company, organization and individual other than the service providers of Tappy, except in the following circumstances.
3.1.1 Sharing upon obtaining your express consent: we will share your personal information with another party upon obtaining your express consent.
3.1.2 Sharing when required by law: we may externally share your personal information in accordance with the provisions of laws and legislations, based on the requirements of resolving actions and disputes or as legally required by an administrative or judicial authority.
3.1.3 Sharing with affiliates: your personal information may be shared with our affiliates to facilitate our joint provision of services to you based on the associated account, recommend information that may be of interest to you or protect the personal safety of and prevent infringement of the property of the affiliates of Tappy, other users of Tappy or the public. We will only share the necessary personal information, such as sharing your necessary account information with our affiliates to facilitate your use of the Tappy account and the products or services of the affiliates, and we will seek your authorization and consent again if we share your sensitive personal information or the affiliates change the purpose for using and processing your personal information.
3.1.4 Sharing with authorized partners: some of our services will be jointly provided by us and the authorized partners only for the purposes set forth in this Privacy Policy. We may share some of your personal information with the partners to provide better customer service and a better user experience. For example, we may arrange for the partners to provide the services. We will share your personal information only for legitimate, appropriate, necessary, specific and defined purposes, and will only share the personal information that is necessary for provision of the services. Our partners shall have no right to use the shared personal information for other purposes irrelevant to the products or services.
We may send the information to the suppliers, service providers and other partners that provide support to our businesses, where such support includes but is not limited to providing technical infrastructure services, analyzing how our services are used, measuring the effectiveness of advertisements and services, providing customer service, facilitating payments or carrying out academic research and surveys. (II) if we establish your violation of laws and legislations or severe violation of the provisions of relevant agreements and regulations of Tappy, or in order to protect the personal safety of and prevent infringement of the property of the users of Tappy and its affiliates or the public, we may disclose your personal information, including relevant violations and the measures taken by Tappy against you, upon obtaining your consent in accordance with laws and legislations or the provisions of relevant agreements and regulations of Tappy.
3.4 Exceptions to Obtaining Prior Authorization and Consent when Sharing, Transferring and Publicly Disclosing Personal Information
We are not required to obtain your prior authorization and consent when sharing, transferring and publicly disclosing your personal information in the following circumstances:
(I) the personal information is related to national security and the security of national defense;
(II) the personal information is related to public security, public health and significant public interests;
(III) the personal information is related to the investigation of a crime, prosecutions, trials, judgment executions, etc.;
(IV) the personal information is collected for the protection of the life, property and other significant legitimate rights and interests of the subject of the personal information or another person, and it is difficult to obtain your consent;
(V) the personal information that is collected has been publicly disclosed to the general public at your own discretion;
(VI) the personal information is information that has been lawfully and publicly disclosed, such as lawful news reports, government information disclosures and other channels;
In accordance with laws and legislations, the sharing and transfer of personal information that has been de-identified with the condition that the data recipient cannot restore and re-identify the subject of the personal information shall not constitute sharing, transfer and public disclosure of personal information, and we are not required to notify you or seek your consent when storing and processing such data.
4. How We Protect the Security of Your Personal Information
4.1 We have adopted reasonably practicable security protection measures that are in line with universally adopted solutions in the industry to protect the security of personal information provided by you, and prevent the unauthorized access, public disclosure, use, modification, damage or loss of personal information. For example, data exchanged between your browser and the server is encrypted with the SSL (Secure Socket Layer) protocol; we will use encryption techniques to improve the security of personal information; we will use trusted protection mechanisms to prevent malicious attacks on personal information; we will deploy an access control mechanism, and exercise our best efforts to ensure that only authorized personnel have access to personal information; and we will organize security and privacy protection training programs to enhance employees' awareness of the importance of protecting personal information.
4.2 We have an industry-leading data security management system addressing the data lifecycle with data at the core, and improve the security of the whole system in multiple dimensions ranging from organizational development, system design, personnel management, product technology and other aspects.
4.3 We will exercise our best efforts to avoid collecting irrelevant personal information by taking reasonably practicable measures. We will only retain your personal information for as long as necessary to fulfill the purposes set forth in this Policy, except where it is necessary to prolong the retention period or permitted by law.
4.4 As the Internet is not an absolutely secure environment, we strongly advise against sending personal information using communication methods that are not recommended by Tappy. You can establish contact and share with others through our services. When you establish communication, conduct a transaction or share through our services, you can independently choose who you want to communicate, transact or share with as the third party who can see relevant information such as your transaction content, contact details, exchanges or shared content.
Please contact the relevant personnel of Tappy's user service immediately if you find that your personal information especially your account or password has been divulged, so that we can take the corresponding measures according to your request.
Please note that when you use our services, the information you share voluntarily or even publicly may involve personal information or even sensitive personal information about yourself or others, such as when you choose to upload pictures containing personal information. Please give more prudent consideration as to whether to share or even publicly share relevant information when using our services.
Please use complex passwords to help us keep your account secure. We will exercise our best efforts to ensure the security of any information you send us.
At the same time, we will also report the disposal of personal information security incidents in accordance with the requirements of regulatory authorities.
5. How You Can Manage Your Personal Information
You can access and manage your personal information in the following ways:
5.1 Accessing Your Personal Information
You have the right to access your personal information, except in exceptional circumstances provided for by laws and legislations. You can access your personal information on your own by the following means:
Profile - If you wish to access or edit the name, profile photo, job and address information, interests, questions and answers, etc., in your profile, you can view the profile by clicking the edit profile on the Settings page.
If you are unable to access such personal information through the above-mentioned path, you can contact us via [Settings - Contact Us].
5.2 Correcting or Supplementing Your Personal Information
If you find an error in your personal information processed by us, you have the right to require us to correct or supplement the personal information. You can submit an application to correct or supplement the personal information through the approach specified in Clause \"(5.1) Accessing Your Personal Information\" in this section.
5.3 Deleting Your Personal Information
You can delete part of your personal information through the approach specified in Clause \"(5.1) Accessing Your Personal Information\" in this section. You can request us to delete the personal information in the following circumstances:
(I) if our processing of personal information violates laws and legislations;
(II) if we collect and use your personal information without obtaining your express consent;
(III) if our processing of the personal information is in material breach of our agreement with you;
(IV) if you no longer use our products or services;
(V) if we will never provide you with products or services again.
If we decide to respond to your request for deletion, we will also exercise our best efforts to notify the parties who have obtained your personal information from us, and request them to delete the personal information in a timely manner, except as otherwise provided for by laws and legislations, or when these parties have obtained your separate authorization.
When you delete the information from our services, we may not immediately delete the corresponding information in the backup system, but will delete such information when the backup is updated.
5.4 Changing the Scope of Your Authorization and Consent
Each operation function can only be realized with some basic personal information (See \"Clause I\" of this Privacy Policy). In addition, you can contact the customer service personnel of Tappy to grant or withdraw your authorization and consent for the collection and use of additional personal information.
When you have withdrawn your consent, we will no longer process the corresponding personal information. However, your decision to withdraw your consent will not affect the processing of personal information previously based on your authorization.
5.5 Restricting Automatic Decision-making by Information Systems
We may rely only on non-manual automatic decision-making mechanisms including information systems and algorithms to make decisions for certain operation functions. If such decisions significantly impact your legitimate rights and interests, you have the right to request an explanation from us, and we will also provide a method of appeal without prejudice to the trade secrets of Tappy, or the rights and interests of other users and the interests of the general public.
5.6 Responding to Your Above-mentioned Request
For security purposes, you may need to provide a written request or prove your identity through other means. We may first request you to verify your identity before processing your request.
We will give a reply within 30 days. If you are unsatisfied with our reply, you can also file a complaint through the customer service personnel of Tappy.
In principle, we will not charge you for reasonable requests, but for repeated requests that exceed a reasonable level, we will charge you for certain costs as the case may be. We may reject requests that are repeated without just cause, require excessive technical means (such as requiring the development of a new system or a fundamental change in existing practices), expose the legitimate rights and interests of others to risks or are extremely impractical.
We will not be able to respond to your request as required by laws and legislations in the following circumstances:
(I) the personal information is related to national security and the security of national defense;
(II) the personal information is related to public security, public health and significant public interests;
(III) the request is related to the investigation of a crime, prosecutions, trials, judgment executions, etc.;
(IV) there is sufficient evidence to prove the subjective malice of or abuse of rights by the subject of the personal information;
(V) responding to your request will cause severe damage to the legitimate rights and interests of yourself or another individual and organization;
(VI) the request involves trade secrets.
6. How Your Personal Information Is Transferred Globally
Personal information that is collected and generated from our operations in the People's Republic of China and within the country will be stored within China except:
(I) where specifically provided for by laws and legislations;
(II) where your express consent has been obtained;
(III) where you conduct proactive activities over the Internet such as cross-border live streaming / posting updates.
With respect to the aforementioned circumstances, we will ensure that your personal information is provided with adequate protection in accordance with this Privacy Policy.
7. How This Privacy Policy Is Updated
Our Privacy Policy may be subject to change.
Without your express consent, we will not limit the rights due to you under this Privacy Policy. In the event of a material change, we will provide a prominent notice.

If you are unsatisfied with our reply, and particularly if you believe that our processing of personal information damages your legitimate rights and interests, you can also seek resolution by filing an action with the court with jurisdiction in the dTappycile of the defendant.
9. Changes to This Privacy Policy
Tappy may update our Privacy Policy from time to time. Thus, you are advised to review this page periodically for any changes. Tappy will notify you of any changes by posting the new Privacy Policy on this page. These changes are effective immediately after they are posted on this page.
Terms of Service
Terms of Service
Expaty (hereafter known as Tappy) provides online social networking service. This agreement includes Tappy’s policy for acceptable use of the Tappy services and content posted on the Tappy website and app, your rights, obligations and restrictions regarding your use of the Tappy services and Tappy’s Terms of Service. In order to participate in certain services provided by Tappy, you (the user) may be notified that you are required to download software or content and/or agree to additional terms and conditions. Tappy hereby specifically reminds you to carefully read these Terms of Service (hereinafter referred to as the "agreement") and all the schedules hereof, to ensure that you fully understand all provisions of the agreement before you register yourself as a user. The additional terms and conditions applicable to the services provided by Tappy in which you choose to participate, those are hereby incorporated into this agreement. You may receive a copy of this agreement by emailing us at: tappyapp.info@gmail.com, Subject: Terms of Use Agreement.
Tappy may modify this agreement from time to time and such modification shall be effective upon being posted on Tappy’s official website. You agree to be bound to any changes to this agreement when you use the services provided by Tappy after any such modification is posted. It is therefore important for you to review this agreement regularly and ensure you are updated as to any changes. Tappy reserves the right, in its sole discretion, to reject, refuse to post or remove any posting (including private messages) by you, or to restrict, suspend, or terminate your access to all or any part of the Tappy Services at any time, for any or no reason, with or without prior notice, and without liability. Tappy exclusively reserves the right to remove your profile and/or restrict, suspend, or terminate your access to any part of Tappy services if Tappy determines, in its sole discretion, that you pose a threat to Tappy and/or it’s members. Tappy also reserves the right to change, alter or remove part of or all your added personal information. With tappyapp.info@gmail.com using URL’s as links to members personal profiles, Tappy reserves the right to alter or remove this at any time without further notification.
Tappy may contain inaccurate, inappropriate, offensive or sexually explicit information or any information prohibited under Section 7 of this Agreement (posted by any members of Tappy, for instance, in their profiles), and Tappy assumes no responsibility or liability for.
1. Eligibility
To create an account on Tappy, you must provide us with at least your name, email address and/or mobile number, and a password and agree to Tappy’s user agreement, which governs how Tappy treats your information. You may provide additional information during the registration flow (for example, your gender, age, job title, company, hobbies and etc.) to create your profile and to receive more customized services on Tappy.
In order to enable a few features on Tappy, you may use Tappy’s address book or ‘contacts’ importer (or other similar features) to upload your phone address book into Tappy’s services. Any information that you upload or sync with Tappy’s services is covered by the user agreement. You can remove your address book and any other synced information at any time. By using Tappy’s services, you agree that Tappy may collect, use and share your information in accordance with Tappy’s Terms of Service, as revised from time to time. By continuing to use Tappy’s services after any changes to this Terms of Service, with or without notice from us, you agree to the revised Terms of Service. By using the Tappy services, you represent and warrant that (a) all registration information you submit is truthful and accurate; (b) you will maintain the accuracy of such information; (c) you are 18 years of age or older and reached the age of adulthood under your national laws; and (d) your use of the services provided by Tappy does not violate any applicable law or regulation. Your profile may be deleted and your membership may be terminated without warning, if Tappy believes that you are under 18 years of age or fail to reach the age of adulthood under your national laws. In providing the services, Tappy collects, stores and uses the following information related to you:
information made available to Tappy by you when you create an account or use services provided by Tappy, such as your name, telephone number, email address and credit card details;
information made available by you while using services provided by Tappy, including information shared by you with others through services provided by Tappy and information you store using services provided by Tappy;
Shared information made available by others using services provided by Tappy about you, such as information contained in posts made by them and information exchanged between you and others using services provided by Tappy; and
information collected by Tappy as you use services, such as certain Location Data, Log Data and public information.
In providing services, Tappy collects, stores and uses the ‘Location Data’. Location Data is information that is collected regarding your location (when you use a location-enabled service), including:
the location of your device when you use services provided by Tappy, such as from the GPS, Wi-Fi, compass, accelerometer or other sensors in your device;
the IP address of the device or internet service you use to access services provided by Tappy,
other information made available by you or others that gives an indication as to where you are or have been located, such as account information that indicates where you are located and shared information posted by you or others indicating your location, such as any geotag information that is embedded in any photos made available by you to Tappy; and
if you have provided Tappy with your location data previously and would like us to delete such existing location data, you may be able to do so via services provided by Tappy.
Tappy collects, stores and uses "Log Data", which is technical information automatically collected by Tappy during use of services provided by Tappy, whether through the use of cookies (as explained in more detail in the Cookies Policy) or otherwise, including:
technical information such as your mobile carrier, configuration information made available by your web browser or other programs you use to access services provided by Tappy, your IP address and your device’s version and identification number,
information about what you have searched for and looked at while using services provided by Tappy, such as web search terms used, social media profiles visited and details of other information and content accessed or requested by you in using services provided by Tappy;
information about apps and softwares used by you,
information about communications by you while using services provided by Tappy, such as the people you’ve communicated with and the time, data and duration of your communications; and
metadata, which means information related to items you have made available through services provided by Tappy, such as the date, time or location that a shared photograph or video was taken or posted.
This agreement shall remain in full force and effect while you use the services provided by Tappy by registering as a member. You may terminate your membership at any time, for any reason, by following the instructions on the member’s account settings page. Tappy may terminate your membership at any time, without warning. Even after membership is terminated, this agreement will remain in effect, including sections 5-17.
2. Privacy of Personal Information
Other than as permitted under this Terms of Service or as otherwise consented to by you, Tappy will not transfer your personal information to any other third parties for any purposes. Tappy and its affiliate companies may share your personal information within its group of companies and with joint venture partners and third party service providers, contractors and agents (such as communication service providers who send emails or push notifications on Tappy’s behalf, mapping services providers who assist Tappy and you with location data, analytics partners who assist Tappy’s business, and advertising partners on services provided by Tappy). In addition, Tappy may allow such third parties to collect your personal information across services provided by Tappy. In each case, Tappy permits sharing and/or collection for the purposes of: (i) providing Tappy’s services to you; (ii) assisting Tappy in carrying out the purposes set out under the “How we use your information” section above; (iii) carrying out Tappy’s obligations and enforcing Tappy’s rights under the Terms of Service; and/or (iv) Tappy’s business, including making Tappy improve its services. These third parties may be located, and use and store your Personal Information, outside of jurisdiction for these purposes. Where Tappy permits any third parties to collect and use your personal information in accordance with the above paragraph, Tappy will make reasonable efforts to ensure that such third parties only use your personal information: (i) in compliance with Tappy’s Terms of service; and (ii) subject to any other instructions given to them, including any appropriate confidentiality and security measures that are implemented by Tappy.
You agree that Tappy or its affiliate companies may be required to retain, preserve or disclose your personal information: (i) in order to comply with applicable laws or regulations; (ii) in order to comply with a court order, subpoena or other legal process; (iii) in response to a request by a government authority, law enforcement agency or similar body (whether situated in your jurisdiction or elsewhere); or (iv) where Tappy believes it is reasonably necessary to comply with applicable laws or regulations. You also agree that Tappy or its affiliate companies may need to disclose your personal information in order to enforce the Terms of service or to, protect Tappy’s rights, property or safety, or the rights, property or safety of Tappy’s affiliate companies or other members of services provided by Tappy.

When you sign up to become a member, you will also be asked to choose a password. You are entirely responsible for maintaining the confidentiality of your password. You agree not to use the account, username, or password of another member at any time or to disclose your password to any third party. You agree to notify Tappy via tappapp.info@gmail.com immediately if you suspect any unauthorized use of your account or access to your password. You are solely responsible for any and all use of your account.
4. Non-commercial Use by Members
The services provided by Tappy are for the personal use of members only, and may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by Tappy. Illegal and/or unauthorized use of the services provided by Tappy, including collecting usernames and/or email addresses of members by electronic or other means for the purpose of sending unsolicited email or unauthorized framing of or linking to the Tappy website is prohibited. Commercial advertisements, affiliate links, and other forms of solicitation may be removed from member profiles without notice and may result in termination of membership privileges. Appropriate legal action will be taken for any illegal or unauthorized use of the services provided by Tappy.
5. Proprietary Rights in Content on Tappy
By displaying or publishing (posting) any content on or through the services provided by Tappy, you hereby grant to Tappy a limited license to use, modify, publicly perform, publicly display, reproduce, and distribute such content solely on and through the services provided by Tappy.
You represent and warrant that: (i) you own the content posted by you on or through the services provided by Tappy or otherwise have the right to grant the license set forth in this section, and (ii) the posting of content by you on or through the services provided by Tappy does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person. You agree to pay for all royalties, fees, and any other monies owing any person by reason of any content posted by you to or through the services provided by Tappy.
The services provided by Tappy contain content generated by Tappy which is protected by copyright, trademark, patent, trade secret and other laws, and Tappy owns and retains all rights in the content generated by Tappy and the services provided by Tappy. Tappy hereby grants you a limited, revocable, non-sub-licensable license to reproduce and display the content generated by Tappy (excluding any software code) solely for your personal use in connection with viewing the Tappy website and using the services provided by Tappy. Any liability raising from your inappropriate use of Tappy’s content shall be borne by you.
The services provided by Tappy contain content of members and other Tappy licensors. Except for content posted by you, you may not copy, modify, translate, publish, broadcast, transmit, distribute, perform, display, or sell any content appearing on or through the services provided by Tappy.
6. Content Posted
Tappy may delete any content that in the sole judgment of Tappy violates this agreement or which may be offensive, illegal or violate the rights, harm, or threaten the safety of any person. Tappy assumes no responsibility for monitoring the services provided by Tappy for inappropriate content or conduct. If at any time Tappy chooses, in its sole discretion, to monitor the services provided by Tappy, Tappy nonetheless assumes no responsibility for the content, no obligation to modify or remove any inappropriate content, and no responsibility for the conduct of the user submitting any such content.
You are solely responsible for the content that you post on or through any of the services provided by Tappy, and any material or information that you transmit to other members and for your interactions with other members. Tappy does not endorse and has no control over the content. Content is not necessarily reviewed by Tappy prior to posting and does not necessarily reflect the opinions or policies of Tappy. Tappy makes no warranties, express or implied, as to the content or to the accuracy and reliability of the content or any material or information that you transmit to other members.
7. Content/Activity Prohibited
The following is a partial list of the kind of content that is illegal or prohibited to post on or through the services provided by Tappy. Tappy reserves the right to investigate and take appropriate legal action against anyone who, in Tappy’s sole discretion, violates this provision, including without limitation, removing the offending communication from the services provided by Tappy, terminating the membership of such violators and filing a lawsuit for Tappy’s loss, if any, caused thereby. Prohibited content includes, but is not limited to content that, in the sole discretion of Tappy:
promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;
violates any patents;
harasses or advocates harassment of another person;
exploits people in a sexual or violent manner;
contains nudity, violence, or offensive subject matter or contains a link to an adult website;
solicits personal information from anyone under 18;
provides any telephone numbers, street addresses, last names, URLs or email addresses;
promotes information that you know is false or misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous;
promotes an illegal or unauthorized copy of another person’s copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files;
involves the transmission of “junk mail,” “chain letters,” or unsolicited mass mailing, instant messaging, “spimming” or “spamming”;
contains restricted or password only access pages or hidden pages or images (those not linked to or from another accessible page);
promotes any criminal activity or enterprise or provides instructional information about illegal activities including, but not limited to making or buying illegal weapons, violating someone’s privacy, or providing or creating computer viruses;
solicits passwords or personal identifying information for commercial or unlawful purposes from other members;
involves commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising, or pyramid schemes;
includes a photograph of another person that you have posted without that person’s consent; or
uses sexually suggestive imagery or any other unfair, misleading or deceptive content intended to draw traffic to the profile such as pictures of celebrities.
The following is a partial list of the kind of activities that are illegal or prohibited on the Tappy platform and through your use of the services provided by Tappy. Tappy reserves the right to investigate and take appropriate legal action against anyone who, in Tappy’s sole discretion, violates this provision, including without limitation, reporting them to law enforcement authorities. Prohibited activities include, but is not limited to:
criminal or tortuous activity, including child pornography, fraud, trafficking in obscene material, drug dealing, gambling, harassment, stalking, spamming, sending of malicious or harmful files, copyright infringement, patent infringement, or theft of trade secrets;
advertising to, or solicitation of, any member to buy or sell any products or services through the use of services provided by Tappy, transmission of any chain letters or junk email to other members. It is also a violation of these rules to use any information obtained from the services provided by Tappy in order to contact, advertise to, solicit, or sell to any member without their prior explicit consent. In order to protect our members from such advertising or solicitation, Tappy reserves the right to restrict the number of emails which a member may send to other members in any 24-hour period to a number which Tappy deems appropriate in its sole discretion. If this agreement is breached and unsolicited bulk email, instant messages or other unsolicited communications of any kind through the use of Tappy services is propagated, it is to be acknowledged that it will have caused substantial harm to Tappy, but that the amount of such harm would be extremely difficult to ascertain. As a reasonable estimation of such harm, you agree to pay Tappy us$50 for each such unsolicited email or other unsolicited communication you send through the use of Tappy services. Provided that the amount is not sufficient to cover Tappy's losses, you shall be liable for the difference;
covering or obscuring the banner advertisements on your personal profile page, or any Tappy page via HTML/CSS or any other means;
any automated use of the system, such as using scripts to add friends or send comments or messages;
interfering with, disrupting, or creating an undue burden on the services provided by Tappy or the networks or services connected to the services provided by Tappy;
attempting to impersonate another member or person;
for band profiles, copying the code for your Tappy player and embedding it into other profiles or asking other members to embed it into their profiles;
using the account, username, or password of another member at any time or disclosing your password to any third party or permitting any third party to access your account;
selling or otherwise transferring your profile;
using any information obtained from the services provided by Tappy in order to harass, abuse, or harm another person;
isplaying an advertisement on your profile, or accepting payment or anything of value from a third person in exchange for your performing any commercial activity on or through the services provided by Tappy on behalf of that person, such as placing commercial content on your profile, posting blogs or bulletins with a commercial purpose, selecting a profile with a commercial purpose as one of your ‘Top 8’ friends, or sending private messages with a commercial purpose; or
using the services provided by Tappy in a manner inconsistent with any and all applicable laws and regulations.
8. Copyright Policy
You may not post, modify, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information belonging to others without obtaining the prior written consent of the owner of such proprietary rights. According to Tappy’s policies, this would lead to termination of your membership privileges of if you repeatedly infringe the copyrights of others upon receipt of proper notification to Tappy by the copyright owner or the copyright owner’s legal agent. Without limiting the foregoing, if you believe that your work has been copied and posted on the Tappy Services in a way that constitutes copyright infringement, please provide the following information by sending it to tappyapp.info@gmail.com: (i) an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest; (ii) a description of the copyrighted work that you claim has been infringed; (iii) a description of where the material that you claim is infringing is located on the services provided by Tappy; (iv) your address, telephone number, and email address; (v) a written statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; (vi) a statement made by you, under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.
9. Member Disputes
You are solely responsible for your interactions with other members of Tappy. Tappy reserves the right, but has no obligation, to monitor disputes between you and other members.
10. Privacy
Use of the services provided by Tappy is also governed by Tappy’s Privacy Policy, which is incorporated into this agreement by this reference.
11. Use Paid Features
Certain value-added services of Tappy (Tappy Premium) require payment for use. You are to select and purchase the required value-added services on the purchase page and make the payment accordingly. Tappy may offer products and services for purchase through the following methods (“In-App Purchases”): iTunes, Google Play, carrier billing, direct billing by Tappy, or other payment platforms authorized by Tappy. At the time of purchase, you should verify the category, price, quantity, duration, method of use, and the period of automatic renewal (if available) of the order, and purchase the services based on your actual needs. Once payment is made, you will be deemed to have confirmed the purchase, and unless otherwise provided by law, you may not request modifications or refunds.
Certain value-added services provided by Tappy require the purchase of Tappy credits. You may acquire Tappy credits through platforms authoritized by Tappy, thereby granting you access to specific value-added services, which include, but are not limited to, gifting, order placement, and other forms of entertainment services.
In the event that you rescind your payment for Tappy credits subsequent to their purchase via iTunes, Google Play, carrier billing, direct billing by Tappy, or any other payment platforms authorized by Tappy, we shall proceed to reclaim the expended credits. Furthermore, any resultant effects associated with the utilization of said credits, inclusive of, but not limited to, benefits, tier levels, experience points, and leaderboard rankings, will be concurrently revoked.
Upon the purchase of credits, you may utilize them to remunerate Tappy service providers for their services, or to procure virtual gifts for Tappy service providers.Such transactions may also enable you to attain specific levels, experience points, and other exclusive features. The precise functionalities are subject to the descriptions provided on the tier page. Tappy strictly prohibits users from soliciting cash from other users under any circumstances, and all users and service providers are forbidden from engaging in private transactions, trading, purchasing (or reselling) credits, as well as buying, selling, or lending accounts.
You acknowledge and agree that, with the exception of the standard withdrawal process for platform-authoritized service providers, the credits and any associated currency obtained within Tappy (such as through festival activities, leaderboard events, mutual gifting) are not redeemable for cash. Tappy retains the exclusive right to interpret the terms related to Tappy credits. If you violate Tappy's regulations, Tappy reserves the right to suspend or terminate your account, which will result in the loss of access to all virtual currency within your account, including credits and discount vouchers.
Upon purchasing Tappy Premium, you will gain the ability to see who likes you and enjoy unlimited Likes every day. You may also engage in entertainment activities,such as gifting and placing orders (if you purchase Tappy credits), in addition to accessing exclusive features beyond standard registered users of Tappy. The specific features are subject to the descriptions provided on the purchase and usage pages. After completing the registration process and making payment for the relevant services through the payment methods offered by the Tappy platform, you will be entitled to use the services of Tappy Premium. Tappy Premium may not be rented, lent, transferred, or licensed to any third party, or be purchased or activated for profit, operational, or other non-personal purposes by you or other individuals.
If you subscribe to an auto-renewable Subscription, your designated payment method will incur charges until the subscription is cancelled. If you purchase value-added services at a price that has not been subject to adjustment, you will not be affected by the possible price adjustment during the subscription validity period, and no supplementary fees will be charged. However, you will be required to make the payment at the latest list price on the purchase page during your next purchase or auto-renewal. To cancel the automatic renewal of your subscription, you must adhere to the instructions and procedures set forth in [Help - How to Cancel Automatic Renewal?]. Failure to cancel the automatic renewal at least 24 hours prior to the end of the subscription period will constitute your consent to Tappy's continuation of billing in accordance with the terms of the agreement and the auto-renewal interval you have selected.If you stop using Tappy within the period of validity of the value-added service, Tappy shall not be responsible for refunding the corresponding service fee for the remaining period. Deleting your account on Tappy or uninstalling the Tappy application from your device would not cancel your subscription.
You may be responsible for any taxes, courier fees, and other expenses incurred as a result of invoice issuance. The specific taxes and courier fees payable may vary depending on the amount paid and the requirements of your location. Tappy will levy such charges in accordance with the applicable legal and regulatory requirements.
12. Disclaimers
Tappy is not responsible for any incorrect or inaccurate content posted on the Tappy website or in connection with the services provided by Tappy, whether caused by members of Tappy or by any of the equipment or programming associated with or utilized in the services provided by Tappy. Profiles created and posted by members on the Tappy website may contain links to other websites. Tappy is not responsible for the content, accuracy or opinions expressed on such websites, and such websites are in no way investigated, monitored or checked for accuracy or completeness by Tappy. Inclusion of any linked website on the services provided by Tappy does not imply approval or endorsement of the linked website by Tappy. When you access these third-party sites, you do so at your own risk. Tappy takes no responsibility for third party advertisements which are posted on this Tappy Website or through the services provided by Tappy, nor does it take any responsibility for the goods or services provided by its advertisers. Tappy is not responsible for the conduct, whether online or offline, of any user of the Tappy services. Tappy assumes no responsibility for any error, Tappyssion, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, any communication between members. Tappy is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email or players due to technical problems or traffic congestion on the Internet or on any of the services provided by Tappy or combination thereof, including any injury or damage to Users or to any person’s computer related to or resulting from participation or downloading materials in connection with the services provided by Tappy. Under no circumstances shall Tappy be responsible for any loss or damage, including personal injury or death, resulting from use of the services provided by Tappy, attendance at an event organized or sponsored by Tappy, from any content posted on or through the services provided by Tappy, or from the conduct of any members of Tappy, whether online or offline. The services provided by Tappy are provided “AS-IS” and as available and Tappy expressly disclaims any warranty of fitness for a particular purpose or non-infringement. Tappy cannot guarantee and does not prTappyse any specific results from use of the services provided by Tappy.
13. Limitation on Liability
In no event shall Tappy be liable to you or any third party for any indirect, consequential, exemplary, incidental, special or punitive damages, including lost profit damages arising from your use of the services, even if Tappy has been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, Tappy’s liability to you for any cause whatsoever and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to Tappy for the services provided by Tappy during the term of membership. Tappy shall not be liable to any damages or losses caused by your or a third party’s actions or Tappyssions, including but not limited to infringement, such as payment service or internet access service by any third party.
14. Disputes
If there is any dispute about or involving the services provided by Tappy, you agree that the dispute shall be governed by the laws of Hong Kong, without regard to conflict of law provisions. Either Tappy or you may demand that any dispute between Tappy and you about or involving the services provided by Tappy must be settled by arbitration utilizing the dispute resolution procedures of Hong Kong, provided that the foregoing shall not prevent Tappy from seeking injunctive relief in a court of competent jurisdiction. The award of arbitration shall be final and binding on Tappy and you.
15. Indemnity
You agree to indemnify and hold Tappy, its subsidiaries, and affiliates, and their respective officers, agents, partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your use of the services provided by Tappy in violation of this agreement and/or arising from a breach of this agreement and/or any breach of your representations and warranties set forth above and/or if any content that you post on the Tappy website or through the services provided by Tappy causing Tappy to be liable to another.
16. Other
This Agreement is accepted upon your use of the Tappy website, or software, or any of the services provided by Tappy and is further affirmed by you becTappyng a member. This agreement constitutes the entire agreement between you and Tappy regarding the use of the services provided by Tappy. The services are provided by MATCHUP UK LIMITED, located at UNIT 417, 4/F LIPPO CTR TOWER TWO NO 89 QUEENSWAY ADMIRALTY, HK. The failure of Tappy to exercise or enforce any right or provision of this Agreement shall not operate as a waiver of such right or provision. The section titles in this agreement are for convenience only and have no legal or contractual effect. This agreement operates to the fullest extent permissible by law. If any provision of this agreement is unlawful, void or unenforceable, that provision is deemed severable from this agreement and does not affect the validity and enforceability of any remaining provisions. The copyright of this Terms of Use shall belong to Tappy, and Tappy reserves the right of interpretation and amendment hereof.
